These terms govern the use of the service PresupuestoYa (presupuestoyavd.com), offered by Diogo Mateus Gonçalves Méndez (NIF 336359101). By creating an account or using the service you accept these conditions, the Legal notice and the Privacy policy.
1. The service
PresupuestoYa is an online tool that lets construction and renovation professionals prepare quotes using a catalogue of materials and tasks with calculation formulas, download them as PDF, send them via WhatsApp and save them in a history, together with a client record.
2. User account
You must be of legal age and provide truthful information. You are responsible for safeguarding your credentials and for the activity of your account. Let us know if you detect unauthorised use.
3. Plans
- Free Plan: up to 3 saved quotes per month and the basic features.
- Pro Plan: €2.99 per month, with unlimited quotes, your own logo and the other features listed on the website at any given time.
Prices are shown before you sign up. We may change plans and prices; price changes to a subscription in progress will be communicated with reasonable notice and will not apply until your next renewal.
4. Pro subscription, payment and cancellation
Payment is handled through Stripe. The subscription renews automatically every month until you cancel it. You can cancel at any time from the “Manage subscription” option in the application (Stripe billing portal). If a payment fails, Stripe will retry it according to its settings; if it ultimately cannot be collected, the subscription will be cancelled and your account will move to the free plan.
5. Refunds and withdrawal
The Pro subscription is charged monthly in advance and renews automatically. You can cancel at any time from “Manage subscription”; you will keep access until the end of the period already paid. Periods already started are not refunded, unless there is a billing error or the law requires it.
The service is aimed at professionals and businesses. If you sign up as a consumer within the meaning of consumer law (Decree-Law No. 24/2014, on distance contracts), you have the right to withdraw from the contract within 14 calendar days, unless you have expressly asked for the digital service to start immediately and acknowledged that, once it has been provided, you lose that right. 6. Acceptable use
You may not use the service for unlawful purposes, try to access other users' data, circumvent plan limits, reverse engineer it or overload the infrastructure. We may suspend accounts that breach these conditions.
7. Your content and your data
The quotes, client records and logos you enter remain yours. You grant us the right necessary to store and display them to you for the sole purpose of providing you with the service. You are responsible for having the right to use that data and for informing your clients (see “Your clients' data” in the Privacy policy, which includes the data processing agreement).
8. Quotes are the professional's responsibility
The prices, productivity rates, waste allowances and formulas in the catalogue are indicative. Before sending a quote to a client, you must check quantities, amounts, taxes and conditions. You are solely responsible for the content of the quotes you issue and for your relationship with your clients. PresupuestoYa is not a party to those contracts.
9. Availability and limitation of liability
We aim to keep the service available continuously, but we do not guarantee that it will work without interruptions or errors. To the extent permitted by law, we are not liable for indirect damages or loss of profit, and our total liability to you is limited to what you have paid for the service in the previous 12 months. Nothing in this limits the rights that the law grants to consumers.
10. Closing your account
You can delete your account at any time from the application (user menu → “Delete my account”), or ask us to do so by writing to presupuestoya.app@gmail.com. When you delete it, your data is erased and the Pro subscription is cancelled immediately, with no refund for the current period (see “Refunds and withdrawal”).
11. Changes
We may change these terms for legal, technical or business reasons. If the change is significant we will let you know; if you keep using the service afterwards, you will be deemed to accept it.
12. Governing law and contact
These terms are governed by Portuguese law, without prejudice to the mandatory consumer protection rules of the country where consumers reside (Rome I Regulation).
